What is the E-2 Visa?
The E-2 Visa is an affordable and achievable way for citizens of Treaty Countries such as Canada, the United Kingdom, Italy, France, and Germany to enter the U.S. for the purpose of directing and developing their U.S. E2 business.
The benefits of the E2 visa are as follows:
The applicant can either move to the U.S. or enter the U.S. freely while on a valid E2 visa. This free movement is particularly important for Canadian citizens who travel to the U.S. frequently to run/start up their U.S. businesses and often face increased scrutiny at entry points.
The applicant's investment can be as low as $70,000 USD.
The applicant's dependents, i.e. a spouse and children, are able to obtain derivative dependent visas. The spouse is able to work upon automatically being granted their E2S status. Only children under 21 qualify as dependents for E2 visa purposes. Children over 21 can pursue their own E2 visas, based for example on an investment with a parent, or an F1 visa to study in the U.S.
The visa is perpetual and can be renewed indefinitely.
Are you a national of an E-2 Visa Treaty Country?
To qualify for the E-2 treaty investor visa, you must be a national of a country that maintains a treaty of Friendship, Commerce, and Navigation and Bilateral Investment Treaties with the U.S. for E2 visa purposes.
Examples of Treaty Countries include Canada, the United Kingdom, Australia, Germany, Italy, France, and many more.

Substantial means that the funds invested must be sufficient to ensure the successful operation of your U.S. business.
Consulting businesses usually require a lower investment and oftentimes, it is difficult to come up with the initial $60,000 investment. While manufacturing businesses often require hundreds of thousands to get the business up in running.
For established businesses, we are often able to use historic expenses as part of the E2 visa investment.
Will your business generate more than enough money beyond what's for earning a living?
Your U.S. Business must be more than marginal. The marginality requirement means that your U.S. business must generate enough money beyond what's needed to sustain yourself and your family in the U.S.
For LLCs, this will be the Cash Withdrawn from the business, and/or your wages.
For Corporations, it will be your salary as well as any dividend distributions.
Typically, income generated from the E2 visa must be higher than $100,000 annually.
Is your business real and operating and not a passive income enterprise?
The E2 visa business must be real, active, and for-profit. Passive investments such as investments in stocks or real estate are not allowed. To prove this requirement we typically submit documents demonstrating the company's bank account, licenses, W2s, permits, office leases, etc.
